Contest Rules and Regulations

The following are basic contest rules for any and all contests run by JAZZ.FM91. Each contest may have its own special qualifications and eligibility rules in which case a separate addition to these rules will be made available.

1. All employees and agents of JAZZ.FM91, and their families, their advertising agencies or representatives are ineligible to enter contests from JAZZ.FM91.
2. To enter contest entrants must be eighteen (18) years of age or older unless specific age is required by type of contest, participating agency or advertiser, by law or unless otherwise stated in contest details.
3. All entrants to any JAZZ.FM91 contest are eligible to enter only once per person per household. Unless otherwise stated, multiple entries by the same person will be discarded and may be deemed cause for disqualification.
4. All JAZZ.FM91 QUALIFIER PRIZE winners and members of the same household are ineligible to win with JAZZ.FM91 for 30 days following the date their prize was won. In the event a winner cannot or does not claim their prize for whatever reason, that winner will remain ineligible for the 30-day period.
5. Winners of advertised GRAND PRIZES and members of their household are not eligible to win another prize from JAZZ.FM91 for a period of 90 days.
6. Contest winners are required to show picture identification when claiming their prize and may be required to sign a release agreeing to all rules and regulations related to their prize. The release may include a skill-testing question.
7. All prizes, unless otherwise stated, must be picked up in person, and signed for by the winner at the JAZZ.FM91 offices Monday to Friday between 9:00 a.m. and 5:00 p.m., within 30 days of winning or in the case of a trip or event, 21 days prior to the trip/event date. Holidays and weekends are included in this 30-day/21-day period. Designated winner’s representatives will be allowed to claim prizes, provided prior arrangements have been made. If prize(s) are not picked up within the stated 30-day/21 day period, the winner waives their rights to the prize, and the said prize becomes the possession of JAZZ.FM91 and may be awarded to another listener at the discretion of JAZZ.FM91. JAZZ.FM91 will not notify winners of time remaining on prizes to be picked up. It is solely the responsibility of the winner to claim their prize in the allotted time specified. No prize will be mailed unless specified during the contest. If the prize is to be mailed or otherwise expedited, JAZZ.FM91 assumes no responsibility for the delivery service or the prize after it leaves the JAZZ.FM91 offices or the premises from which it is set to be claimed.
8. All prizes won are as-is, unless otherwise stipulated by the sponsor and can not be exchanged for cash or equal cash value. Prizes are non-transferable.
9. All contest winners agree to allow JAZZ.FM91 to use their name, and/or likeness and/or voice for promotional purposes, without further compensation. All calls coming into, or originating from JAZZ.FM91 may be recorded and may be aired on JAZZ.FM91 without further approval.
10. JAZZ.FM91 is not responsible for any computer equipment, software or communications equipment malfunctions that either inhibit or increase the chances of winning a contest. This relates to the absence of network communications or any transmission that is incomplete or incomprehensible or erased. In the event two or more phone lines are tied together during a phone-in contest, the entire call and all callers cited together will be disqualified and another caller will be taken. JAZZ.FM91 cannot award duplicate prizes to all parties in a “tied together” situation. In the case of computer equipment, software or communications equipment malfunctions, the decision of JAZZ.FM91 will be final.
11. In the event that multiple identical submissions are received for a particular contest, the winner will chosen by random draw from all of the identical entries.
12. JAZZ.FM91 reserves the right to revoke prizes if the winner does not meet any or all eligibility requirements, even though an announcement may have been made on-the-air indicating that the person was the winner.
13. If federal, provincial or municipal taxes are required to be paid for a prize, it is the sole responsibility of the winner to pay said taxes unless the specific contest rules state otherwise.
14. JAZZ.FM91 may, due to the unavailability of prizes awarded, substitute another prize of equal value for the prize originally won.
15. JAZZ.FM91 will not be responsible, or held liable for prizes awarded to an event that is canceled due to circumstances beyond our control, or for products that may not work as described.
16. With respect to any disputes regarding contests, the decision of JAZZ.FM91 management will be final.
17. JAZZ.FM91, its agencies and representatives shall not be liable or responsible for any claim, injury or damage arising from any contest or prize awarded in a contest.
18. All contest entries become the property of CJRT-FM INC., owner and operator of JAZZ.FM91, which may withhold any or all contest materials for any reason station management deems crucial to the completion of the contest, or for any reasons relating to membership, publicity and/or advertising.
19. Unless otherwise stated, any contest conducted at a facility where paid admission is required, may be entered at JAZZ.FM91 studios prior to the event without any paid consideration to enter the event.
20. For travel prizes awarded, winners and all traveling companions must possess a valid passport or other documents acceptable (example - VISA) to the relevant governmental authorities required for entry, departure and travel through each destination. Winners must provide a photocopied facsimile of the winner and travel companion’s passport and/or other necessary travel documents within 21 days prior to the trip in order to claim the prize. Failure to provide the necessary documentation by the required deadline will result in the winner waiving their rights to the prize, with the said prize becoming the possession of JAZZ.FM91 to be awarded to another listener at the discretion of JAZZ.FM91
21. By entering a JAZZ.FM91 contest, each entrant agrees to and is deemed to have accepted all terms, conditions, rules and regulations as written herein.

CONTEST RULES & REGULATIONS – TRIP GIVEAWAYS

“VIP WEEKEND GETAWAY" TO MONTREAL

JAZZ.FM91/PORTER AIRLINES

1. a) “Contest Period” starts at 12:01a.m.on Monday, August 1, 2011 12:01AM up until 10:00AM on Friday, August 12, 2011 the “Contest Closing Date”. To enter, listen Monday, August 1 through Friday, August 12for the cue to call the JAZZ.FM91 prize line at 1877-879-5400 and enter. Ten (10) qualifiers for the trip will enter into a grand prize draw. One (1) winner will be announced the following Monday August 15, 2011 between 6:00AM and 10:00AM. All times are Eastern Times.

NO PURCHASE NECESSARY. To enter this contest without phoning the prize line, please hand print your names, address, day and evening phone numbers, e-mail address, age, Contest Name for which you are entering for a chance to win and a 100 word handwritten letter explaining why you want to win and mail it JAZZ.FM91, 4 Pardee Avenue Unit#100, Toronto, Ontario M6K 3H5, Attention: JAZZ.FM91/PORTER AIRLINES TO MONTREAL CONTEST. You will receive one entry into the Contest during the entry period which your request was postmarked and received, to be postmarked by the Contest Closing Date. Limit of one (1) mail-in request per postage stamped envelope per day.

b) A random draw by a JAZZ.FM91 representative from all completed entries received as of the Contest Closing Date will be made on Monday, August 15^th between 6:00AM and 10:00AM at JAZZ.FM91 offices, 4 Pardee Avenue, Unit #100, Toronto, Ontario. The selected entrant will be contacted via telephone number or e-mail as indicated on the selected entrant’s e-mail / mail entry.

c) If a selected entrant cannot be reached by Wednesday, August 17^th, 2011 or declines the prize, or fails to return a signed release and acknowledgment form as specified below, another entrant will be selected on Thursday,August 18, 2011 from all remaining eligible entries received.

d) In the event that a selected entrant incorrectly answers the skill testing question, another entrant will be selected the following business day from all remaining eligible entries.

e) One entry per person. If the identity of an entry is disputed, the authorized account holder of the e-mail address submitted at the time of the entry will be deemed as the entrant. The individual assigned to the e-mail address for the domain associated wit the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof that he / she is the authorized account holder of the e-mail address associated with the selected entry. All entries must be submitted from a valid e-mail account that may be identified by reverse domain name search. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).

2. No purchase, expenditure or investment is necessary to enter this Contest. Participants will be eligible to win (1) Grand prize of a trip for two to Montreal, consisting of: round trip flights on Porter Airlines for two (2) from Toronto to Montreal on Friday, two (2) nights stay at The Fairmont The Queen Elizabeth; Two (2) tickets to see a live jazz show in Montreal .

Winner and travel companion are solely responsible for ground transportation, taxes, transfers, travel insurance, spending money, tips, meals and other travel and hotel charges not specifically mentioned as part of the prize. Winner and travel companion are solely responsible for obtaining their own travel documents such as passport or travel visa in advance of the departure date. JAZZ.FM91 is not responsible in the event winner and / or travel companion are refused entry to destination Country or re-entry to Canada for whatever reason and any unused portion of the prize will be forfeited. Winner and traveling companion must travel together on the same itinerary. Both winner and traveling companion must be over the age of 19 in order to take part in the prize. Trip must be taken on dates specified by JAZZ.FM91. In the event winner and / or guest cannot travel within the dates specified by JAZZ.FM91 the prize will be forfeited. All travel arrangements and bookings will be arranged by JAZZ.FM91 or its agents. No responsibility is assumed by JAZZ.FM91 for any other factor beyond its reasonable control, or for a cancelled, delayed, or re-scheduled event / tour for any reason whatsoever. JAZZ.FM91 is not responsible in the event the winner and / or guest is refused entry to the event / tour venue for whatever reason and any unused portion of the prize will be forfeited.

3. All prizes must be accepted as awarded and may not be transferred or exchanged. JAZZ.FM91 reserves the right to substitute a prize of at least equal or greater value in the event of the unavailability, for whatever reason, of the advertised prize.
4. In order to win, selected entrant must first correctly answer, unaided, a time limited, mathematical skill testing question, posed by telephone at a mutually convenient time. JAZZ.FM91 judges’ rulings are final and without appeal in all matters related to the Contest and the awarding of prizes.
5. Selected entrant will be required to return a signed release and acknowledgment form before being declared a winner. The traveling companion must also return a signed release and acknowledgment form before being ticketed.
6. By entering the Contest, each entrant consents to the use of his / her entry, name, and city of residence and / or photograph in any publicity carried out by JAZZ.FM91 and / or its advertising agencies, without further compensation. Winner consents to their photo being taken by JAZZ.FM91 for such use, without further compensation. All entries become the property of JAZZ.FM91.
7. This contest is open to residents of Ontario 19 years of age and over as of the date of entry, except employees of JAZZ.FM91, its parent and affiliate companies; its representative and agents, the Contest suppliers, and those with whom they are domiciled. The Contest is subject to all applicable federal, provincial and municipal laws and regulations.
8. No correspondence will be entered into except with the selected entrant.
9. Chances of winning depend on the number of eligible entries received. JAZZ.FM91 is unaware of how many entrants there may be. The winner may come from any geographic area, so long as they otherwise qualify to enter the Contest.
10. All entries which are incomplete, illegible, damaged, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the rules may be disqualified by JAZZ.FM91. JAZZ.FM91 takes no responsibility for lost, misdirected, late or destroyed entries, or for typographical or other production errors/
11. All entries become the property of JAZZ.FM91 who assumes no responsibility for lost, stolen, delayed, damaged or misdirected entries or for failure of the Internet or JAZZ.FM91 network during the Contest Period, for any problems or technical malfunction of any telephone network or lines, cell sites, microwave dish, antenna, switch, computer on-line systems, servers, access providers, computer equipment, software, failure of any communication or traffic congestion on the JAZZ.FM91 or other network, or any combination thereof including any injury or damage to an entrant’s or any other person’s wireless device or personal computer related to or resulting from playing or downloading or sending any material in the Contest. JAZZ.FM91 reserves the right, in its sole discretion, to cancel or suspend the online or e-mail portion of this Contest should a virus, bug or other cause beyond the reasonable control of JAZZ.FM91 corrupt the security of proper administration of the Contest. Any attempt to deliberately damage any equipment or system or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, JAZZ.FM91 reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
12. JAZZ.FM91 is collecting personal data about the entrants for the sole purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless entrants provide JAZZ.FM91 with explicit permission to do so as indicated at the time of entry. 13. This Contest will be run in accordance with these rules, subject to amendment by JAZZ.FM91. Entrants must comply with these rules, and will be deemed to have received and understood the rules if they participate in the Contest.
14. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.
